If he is ever accused of adultery, claims marriage, or is open to suspicion, his claim will be accepted without proof or oath, unless the contrary is proved by the necessary Shari'ah evidence.
And more importantly:
Article 234 of the Islamic Penal Code:
The limit of punishment for the "perpetrator" is death only in the case of violence, reluctance, or if he has the conditions of the horse, and otherwise it is 100 lashes.
However, Lawat's Shariah limit for the "object" in any case is the "existence or non-existence of horses" execution.
