 رئیس شعبه ی ۱۹ دادگاه عمومی (حقوقی) شهرستان کرمانشاه  در نامه ای به دیوان عالی کشور، خواستار اعلام نظر ارشادی دیوان، در خصوص تلقی «حکم» به «قرار» توسط دادگاه تجدید نظر شده است.

 

In this context, the 41st Branch of the Supreme Court, in expressing its opinion regarding the declared difference of interpretation, has stated that the Court of Appeal is obligated to make a judicial determination on the order or ruling under appeal. The Court of Appeal is certainly not permitted to interpret or reclassify a ruling as an order if a ruling has been issued.
