Recently, I also wrote about the initial court proceedings for the young defendant of this major international financial group. With the diagnosis and unprecedented ruling of His Honor Dr. Amin Toyserkani, he was convicted solely on the charges of forgery, using forged documents, and fraud amounting to (two billion and five hundred million tomans!). The remaining charges, especially money laundering, were acquitted or prosecution suspended based on the principle of "Dar' (avoiding punishment in cases of doubt) under Article 120 of the Islamic Penal Code and Article 37 of the Constitution. Orders to dismiss prosecution for other defendants were also upheld and confirmed.
As a result, thank God, with the pen of this capable judge, it was determined that this group is not an organized criminal group subject to Article 130 of the Islamic Penal Code, and that only one defendant alone committed a minor crime!!!
