ابطال بخشنامه ممنوعیت ارسال اظهارنامه برای مقامات دولتی

By the decision of the General Board of the Administrative Court of Justice, a part of the 2013 directive of the General Directorate of Judicial Electronic Services was revoked.

This instruction stated:

"The service offices strictly refuse to receive any declaration for government officials and heads of government (such as the president, etc.) and refer the matter to the secretariats or public communication centers of the organization or body concerned."

The General Board considered this circular contrary to Article 156 of the Civil Procedure Code, which stipulates:

Demand a declaration from another, provided that the deadline for the demand has arrived. In general, everyone has the right to communicate to the other party the statements which he wishes to make concerning his transactions and obligations with another person officially. The declaration is issued by the Land Registry Office or the Courts Offices.

Note-The Registry Office and the Courts Office may refuse to communicate statements that contain material contrary to morality and decency.
