Statement by two cyberspace judges on criminalizing unfiltering of social networks: Unfiltering American-Zionist social networks is a crime

The opinion of the investigator/assistant prosecutor and the final decision of the prosecutors of these two prosecutor's offices will certainly be historic.

 Abdi Media proposes that the honorable Judges, Mr. Abdolsamad Khorramabadi and Mr. Javad Javidnia, with the legal arguments of this statement, file a complaint/report from the non-clerical members of the Supreme Council of Cyberspace to the head of the Public Prosecutor's Office and the clerical members to the Special Prosecutor for the Clergy.

The opinion of the investigator/assistant prosecutor and the final decision of the prosecutors of these two prosecutor's offices will certainly be historic.

The text of the statement is as follows:

Abdolsamad Khorramabadi and Javad Javidnia

  In a country like Malaysia that is not in a state of war and is not at war with the United States, the country's Minister of Communications announced yesterday that American social networks such as WhatsApp, Facebook, Instagram, X (Twitter) and YouTube must obtain a license from the government from next year or they will be filtered.

On the other hand, the United States is at direct war with the Islamic Republic of Iran and the Axis of Resistance, and Iran is in a state of war with American agents in the region, but in such a situation, the Iranian president has proposed to lift the restrictions and unconditional activity of the social networks of the American enemy. In my opinion, since I have written my doctoral dissertation in the field of cybercrime and have taught judges in this field for many years, in this situation, agreeing to lift the restrictions of any of the American social networks in Iran's cyberspace is a form of cooperation with the enemy and is considered a criminal act.   

PN: Article 508 of the Islamic Penal Code (Ta'zirat Section) stipulates: "Anyone or group that cooperates with hostile foreign states in any way against the Islamic Republic of Iran, if Moharebeh is not recognized, shall be sentenced to one to ten years in prison." I confirm and declare that all the members of the Supreme Council of Cyberspace who voted in favor of this resolution, which of course is illegal due to the non-implementation of the decision of this council since 2019, as well as the Minister of Communications and the Director General of Network Security of that office, have committed this crime and should be prosecuted and punished. Of course, we hope that as we have heard, the Head of the Judiciary and the Attorney General of the country will not be among the supporters of this resolution, and otherwise...
