The three-year ban on judges practicing law in their last place of service does not apply to extra-judicial judges, such as judges of the provincial appellate courts or the Supreme Court

Based on the decision issued by the First Branch of the Supreme Disciplinary Court of Judges, the Disciplinary Court of the Mazandaran Bar Association in 2018 in a judgment considered the representation of a retired judge in his last place of judicial service before the expiry of his three-year term as a disciplinary violation and voted to reprimand him by publishing it in the official newspaper and magazine of the Association.

Appealing this ruling, the judges of the First Branch of the Supreme Disciplinary Court of Judges, citing the fact that "the prohibition stipulated in Note 4 of Article 6 of the Law on the Quality of Obtaining a Bar License applies to judges who have served in the city or district and does not include extra-disciplinary judges such as judges of the Provincial Appeals Courts or the Supreme Court", rejected the judgment issued by the Disciplinary Court of the Mazandaran Bar Association and the acquittal of the defendant's lawyer have been issued.
