ماجرای عفو عبدالله نوری توسط آیت‌الله خامنه‌ای چه بود؟

Following the writing of Akbar Hashemi Rafsanjani's diary, Abdi Madya had announced before this note that Abdullah Nouri did not directly object to the ruling of Judge Sheikh Muhammad Salimi, the then head of the second branch of the Special Clergy Court, because he did not consider this special court to be legal. And it seems that Sheikh Mohsen Rahami, his lawyer, sent the protest to the head of the Judiciary, whose fate is not known.

It is interesting to know that this public action of Abdullah Nouri and the sidelines of the other press of that time caused the parliament when it was involved in approving the civil procedure! was, he suddenly came to the idea of dressing the prosecutor's office and the special clerical court in the civil procedure and approved Article 528 with the proposal of a representative in the parliament.

According to this article, according to principles 5 and 57 of the Constitution, the Prosecutor's Office and the Special Clergy Court will deal with the crimes of clerics as long as the leadership deems it expedient to continue its work.

Of course, the approvers were in a hurry and they forgot that it is more correct to deal with the accusations of clerics rather than the crimes of individuals from the beginning; However, unfortunately, later in the criminal procedure, the law writers have written and approved (crime) in many articles (accusation), especially in the stages of the prosecution. While in principle, even the writing (guilty) is not correct, but (convicted) is correct, because every convict, although certain in the opinion of the judges, may be acquitted at another stage, according to the opinion of other judges, which is not the subject of my discussion in this note.

Regarding his amnesty, there was no request from Abdullah Nouri district addressed to the leader of the Islamic Republic or any other authority. Rather, after the death of his brother Dr. Alireza Nouri, the representative of the 6th Parliament, the clerical representatives of the time sent a letter to Khamenei asking for his pardon, to which the leader of the Islamic Republic agreed and was released from prison.

For the details of its process, one should read the memoirs of Akbar Hashemi Rafsanjani in 2000 and 2001, or the memoirs of Abdullah Nouri and others.

Abdollah Abdi
