A development in the judiciary? Issuing a ruling contrary to the opinion of the second leader of the Islamic Republic.

Despite the decree of the second leader of the Islamic Republic prohibiting courts from interfering with the approvals of the Supreme Council of the Cultural Revolution, the approval of the Supreme Council of the Cultural Revolution regarding the restriction of judicial review in educational matters has been annulled.

Branch 18 of the Civil Court of the Shahid Beheshti Judicial Complex in Tehran, presided over by Hamidreza Kamrani, issued a ruling nullifying the approval of the Supreme Council of the Cultural Revolution that had excluded the handling of certain disputes and complaints in the fields of education and research from the jurisdiction of judicial authorities.

The approval of the Supreme Council of the Cultural Revolution, dated February 20, 2024 (1 Esfand 1402), stipulated that matters and affairs related to scientific, educational, and research activities, as well as decisions and rulings issued by specialized boards and committees within the Ministries of Science, Research and Technology and Health, Treatment and Medical Education, the National Organization for Educational Testing (Sanjesh), and other educational and research centers, would be considered outside the jurisdiction of judicial authorities, particularly the Administrative Court of Justice.

With the issuance of this ruling, the possibility of filing complaints and objections against decisions and rulings related to scientific and educational fields before judicial authorities, including the Administrative Court of Justice, will remain in place, and the aforementioned approval cannot prevent judicial review of such claims.

This is while the second leader of the Islamic Republic had issued a written order declaring the approvals of the Supreme Council of the Cultural Revolution to be outside the scope of judicial review.
